School Bags Search

I go to a school in the UK, and hoodies have been banned. Can the school teachers, legally, search the pupils bags and confiscate any non-school uniform without their permission? I thought the teachers had to have a warrant?

My 6th grader came home today saying that two students had had something stolen from their desks overnight. Teacher told the students that if these items were returned by the end of lunch time there'd be no punishment. When neither item was returned, a bag check ensued, which didn't identify the guilty party/ies. Tomorrow there's going to be a tidy-tray (desk) check and a note is going home with each student asking parents to check their child's room. Does anyone else think this is a bit of over-kill? Is it in fact legal to be searching students' belongings like this? (I know we've got nothing to worry about of course!, but it's the principle of the thing)

I think the answer to this issue is not the legality of the bag check but if you agree with the check or not. The teacher by doing an internal investigation for the missing items is in fact giving the culprit a chance from facing the police which may have harsher penalties if identified. By enlisting the parents to check their child's room is for the social well being of the child. If they discover the missing items in their child's room its the parents responsibility to educate their child of his / her mistake. By placing blind faith on the child would only encourage the child to make another mistake again. It is not an over-kill. The child may not even know their mistake if its not pointed out to them and will go on their merry way making the same mistake again and again. From your description of the event there is no discrimination of any students and all are treated equally. So i do not see any problem with this issue. Unless you would prefer that the problem be solved with all legal grounds covered the teacher should just call the police and let the police handle it. But in my view it would really be an over-kill situation.

The ACLU (American Civil Liberties Union) is the group that files suit on behalf of people in your situation, but it might not come to that. Will your parents speak to the school? This is a violation of your religious rights and an attorney can provide you with advice if talking to the school doesn't help.

Yes they can. If you are under 18, and the school is "in charge" of your welfare while you are on their property, they can do just about anything they want if they claim it was out of concern for your safety.
Even though there are guidelines for searching peoples private property, there are always ways to get around them. For instance, the administration of you school could say that they were very concerned about a fire hazard, so they searched for lighters and combustibles as a safety precaution. And of course, they can always use the health angle, or the addictive substance angle.
They might not get away with searching your private property for something that wasnt a safety issue, but since smoking involves fire its probably considered a valid search.
And as far as "not getting caught" smoking, what exactly does that mean? That you did it but they didnt see you? Do you realize how easy it is to tell if someones been smoking? A non smoker could smell it on your clothes two rooms away, especially if it had been done in the last hour or two.
